1. Introduction & Agreement to Terms

Welcome to LegacyStream AI. These Terms of Service ("Terms") govern your use of our website, platform, mobile application, and all related services (collectively, the "Services") provided by Pagenchant, LLC, doing business as LegacyStream AI ("LegacyStream AI," "we," "us," or "our").

Our Services are designed to help individuals create professionally written life biographies through AI-guided structured interviews. We serve individual users ("Biographers"), their designated facilitators ("Coaches"), and institutional or professional partners ("Partner Organizations").

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. Eligibility & Account Registration

2.1 Age Requirements

You must be at least 18 years of age to create an account and use our Services independently.

2.2 Account Registration

To access most features of our Services, you must create an account. When registering, you agree to:

• Provide accurate, complete, and current information about yourself
• Maintain and promptly update your account information as needed
• Keep your account credentials confidential and secure
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account at security@legacystreamai.com

We reserve the right to refuse registration, terminate accounts, or remove content at our sole discretion.

2.3 Account Types

LegacyStream AI offers the following account types:

• Biographer Account — The individual whose life story is being created
• Coach Account — A facilitator (life coach, family member, care professional, etc.) who guides one or more Biographers
• Family Member Account — A facilitator appointed by a Biographer account
• Partner Organization Account — Institutional partners such as estate planning firms, wealth advisors, memory care facilities, or hospice organizations

3. Description of Services

LegacyStream AI provides an AI-powered biography platform that guides individuals through structured interview sessions to create professionally written life stories. Our Services include, but are not limited to:

• AI-guided interview sessions that capture life stories through natural conversation
• Professional narrative generation from interview content
• Digital biography storage and management
• Collaboration tools for Coaches and family members
• Optional printed biography books and digital publications
• Partner portal for professional and institutional users
• ADRD-adapted session formats for individuals with Alzheimer's or dementia (where offered)

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice where practicable.

4. User Content & Intellectual Property

4.1 Your Content

You own your content. When you provide written materials, voice recordings, photographs, videos, biographical information, or any other content through our Services (collectively, "Your Content"), you retain full ownership of all intellectual property rights in that Content.

By submitting Your Content to LegacyStream AI, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Process, store, and display Your Content to provide the Services to you
• Use Your Content to generate your biography and related outputs
• Create backup copies for data protection purposes
• Share Your Content with service providers who assist in delivering the Services, subject to appropriate confidentiality obligations

We will not use Your Content for marketing, advertising, or promotional purposes without your explicit written consent. We will not use Your Content to train AI models beyond improving the service for your specific account, unless you provide separate written consent.

4.2 AI-Generated Content

LegacyStream AI uses artificial intelligence to transform your interview responses into narrative biography content. Regarding AI-generated content:

• You retain ownership of the final biography content produced from your personal stories and information
• The AI writing tools, templates, interview frameworks, and platform infrastructure remain the intellectual property of Pagenchant, LLC (d/b/a LegacyStream AI)
• You are responsible for reviewing and approving AI-generated content before sharing or publishing
• AI-generated content should be reviewed for accuracy — it is a tool to assist storytelling, not a substitute for your judgment

4.3 Content Submitted by Others

If your biography includes content about or from other individuals (family members, friends, colleagues), you represent and warrant that:

• You have obtained appropriate consent from those individuals to include their stories, images, or information
• For any person under the age of 18, you have obtained verifiable parental consent
• The inclusion of third-party content does not violate any person's privacy, dignity, or legal rights

4.4 Content Standards

You agree not to submit Content that:

• Is false, misleading, defamatory, or fraudulent
• Is obscene, pornographic, or sexually explicit
• Promotes violence, hatred, or discrimination against any individual or group
• Infringes the intellectual property, privacy, or other legal rights of any third party
• Contains malware, viruses, or other harmful code
• Violates any applicable local, state, national, or international law or regulation

We reserve the right to remove Content that violates these standards, though we are not obligated to review all Content submitted to our platform.

5. AI Transparency & Disclosure

LegacyStream AI uses artificial intelligence throughout our platform. We are committed to transparency about how AI is used in our Services.

5.1 How We Use AI

• Interview Facilitation: AI guides biographical interview sessions with structured, contextually relevant questions
• Narrative Generation: AI transforms interview responses into professionally written biography prose
• Content Organization: AI structures biographical content into coherent chapters and themes
• Quality Review: AI assists in reviewing biographical drafts for coherence and completeness

5.2 AI Accuracy & Limitations

While our AI systems are designed to produce high-quality biographical content, you acknowledge that:

• AI-generated content may contain inaccuracies, omissions, or errors
• You are responsible for reviewing, editing, and verifying all AI-generated content
• AI-generated narratives reflect the information you provided and should not be treated as independently verified fact
• LegacyStream AI is not liable for inaccuracies in AI-generated content that arise from inaccurate or incomplete information you provided

5.3 AI & Sensitive Populations

For users with cognitive impairments, including those with Alzheimer's disease or related dementias, our ADRD-adapted services are designed with additional care. However, Coaches and family facilitators using the platform on behalf of cognitively impaired individuals bear responsibility for ensuring the accuracy and appropriateness of captured content.

6. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You specifically agree not to:

• Access or use the Services to abuse, defame, harass, threaten, or intimidate any person
• Use the Services to transmit unsolicited commercial communications (spam)
• Attempt to gain unauthorized access to any part of the Services or other users' accounts
• Use automated tools (bots, scrapers, crawlers) to access or extract data from our Services without written permission
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of our Services
• Resell or commercialize access to the Services without a formal Partner Agreement with LegacyStream AI
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Services in any manner that could damage, disable, overburden, or impair our infrastructure
• Violate any applicable laws, regulations, or third-party rights
• Use the Services to collect or harvest personal information about other users

7. Subscription Plans, Pricing & Payments

7.1 Subscription Plans

LegacyStream AI offers various subscription plans for individual Biographers, Coaches, and Partner Organizations. Current pricing is available at legacystreamai.com/pricing and is subject to change with notice.

7.2 Billing & Renewal

• Subscriptions automatically renew at the end of each billing period unless cancelled
• You authorize us to charge your payment method on a recurring basis for the applicable subscription fee
• We will provide reasonable advance notice of any price changes before they take effect
• Cancellation must be submitted through your account settings prior to the renewal date

7.3 Refund Policy

We offer a 30-day satisfaction guarantee for new subscriptions. If you are not satisfied with the Services within the first 30 days, contact us at support@legacystreamai.com for a full refund. After 30 days, subscription fees are non-refundable except as required by applicable law. Printed biography books are non-refundable except in the case of printing defects or shipping damage.

7.4 Partner & Institutional Pricing

Partner Organizations and Coach subscribers are subject to separate pricing agreements. Institutional licensing terms, including per-seat and per-facility arrangements, are governed by a separate Partner Agreement.

8. Privacy & Data Protection

Your privacy is fundamental to everything we do at LegacyStream AI. Our complete Privacy Policy is available at legacystreamai.com/privacy and is incorporated into these Terms by reference.

Key privacy commitments include:

• Your biographical content is private by default and only accessible to you and those you explicitly authorize
• We do not sell your personal information or Your Content to third parties
• We do not use Your Content to train AI models without your explicit consent
• We comply with applicable data protection regulations including CCPA, GDPR (for EU/UK users), and applicable state privacy laws
• You may request deletion of your data at any time, subject to legal retention obligations

9. Third-Party Services & Integrations

Our Services may integrate with or direct you to third-party platforms, tools, or services. We are not responsible for the privacy practices, security, or content of third-party services. Your use of any third-party service is subject to that service's own terms and policies.

Where we integrate with third-party services (such as payment processors, CRM platforms, or email services), we select trusted providers and require appropriate data protection agreements.

10. Coach & Partner Organization Obligations

10.1 Coach Responsibilities

Coaches using LegacyStream AI to facilitate biography sessions on behalf of Biographers agree to:

• Obtain informed consent from each Biographer before initiating or facilitating sessions
• Accurately represent the nature and purpose of the biography process
• Maintain appropriate professional and ethical standards in their facilitation role
• Protect the confidentiality of Biographer content and personal information
• Not use Biographer content for any purpose other than facilitating their biography

10.2 ADRD & Vulnerable Population Safeguards

Coaches or family facilitators working with individuals with Alzheimer's disease, dementia, or other cognitive impairments must:

• Ensure that the Biographer (or their authorized legal representative) has provided informed consent
• Exercise appropriate professional judgment regarding the Biographer's capacity and wellbeing
• Comply with all applicable professional, ethical, and legal standards governing their practice
• Not use the platform in any manner that could exploit, harm, or unduly influence a vulnerable individual

10.3 Partner Organization Compliance

Partner Organizations are responsible for ensuring that their employees, contractors, and representatives comply with these Terms and any applicable Partner Agreement. Partner Organizations agree to implement appropriate internal safeguards to protect Biographer data and content.

11. Intellectual Property Rights of LegacyStream AI

The LegacyStream AI platform, including its software, AI systems, interview frameworks, templates, design elements, branding, and all associated intellectual property, is owned by Pagenchant, LLC (d/b/a LegacyStream AI) and protected by applicable intellectual property laws.

You may not:

• Copy, reproduce, distribute, or create derivative works from our platform or Services
• Use our trademarks, logos, or branding without prior written permission
• Remove or alter any proprietary notices or labels on our Services
• Use our intellectual property in any manner that implies endorsement or affiliation

12. Data Portability & Account Termination

12.1 Your Right to Your Data

You may export or download Your Content at any time through your account dashboard. We support data portability and will not hold your biographical content hostage. Available export formats include PDF, digital document formats, and audio files (where applicable).

12.2 Account Termination by You

You may terminate your account at any time through your account settings. Upon termination:

• You will retain access to download Your Content for 30 days following termination
• After 30 days, Your Content will be permanently deleted from our systems
• Notify us at support@legacystreamai.com if you wish to extend this period

12.3 Termination by LegacyStream AI

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will provide reasonable notice where possible. In cases of serious violations, we may terminate accounts immediately.

13. Copyright & DMCA

LegacyStream AI respects intellectual property rights and expects our users to do the same. If you believe that content on our platform infringes your copyright, please submit a DMCA notice to:

1. Your signature or authorized representative's signature
2. Identification of the copyrighted work claimed to be infringed
3. Identification of the infringing material and its location
4. Your contact information
5. A good faith belief statement
6. A statement of accuracy under penalty of perjury

14. Disclaimers of Warranties

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

15. Limitation of Liability

Some jurisdictions do not allow limitations on liability for certain types of damages, so some limitations above may not apply to you.

15.1 Indemnification

You agree to defend, indemnify, and hold harmless LegacyStream AI and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

16. Dispute Resolution & Arbitration

16.1 Informal Resolution

Before initiating any formal dispute process, you agree to first contact us at legal@legacystreamai.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes within 30 days.

16.2 Binding Arbitration

If informal resolution fails, all disputes arising from or relating to these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as otherwise provided herein.

• Arbitration shall be conducted in Spokane, WA or virtually
• The arbitrator's decision shall be final and binding
• Each party shall bear its own arbitration costs, subject to AAA rules

16.3 Exceptions

Either party may bring claims in small claims court for disputes within the applicable jurisdictional limits. Either party may seek injunctive or equitable relief in court for claims involving intellectual property infringement or unauthorized use.

16.4 Class Action Waiver

If this waiver is found unenforceable, then the entirety of this arbitration section shall be null and void.

16.5 Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Spokane, WA.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Sending an email to the address associated with your account
• Displaying a prominent notice within the Services
• Updating the "Last Updated" date at the top of these Terms

Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to revised Terms, you must discontinue use of the Services and may terminate your account.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable Partner Agreement or subscription agreement, constitute the entire agreement between you and LegacyStream AI regarding the Services and supersede all prior agreements.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or our right to enforce it in the future.

18.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
